ClearSight Studio — Terms of Service

Welcome to ClearSight Studio (“Company,” “we,” “our,” “us”). By booking or using our services, you (“Client”) agree to these Terms of Service.

1. Services Provided

  • Residential & commercial photography
  • FAA-certified aerial drone imagery & video
  • 3D tours & floor plans
  • Property marketing media

2. Bookings & Cancellations

  • Bookings must be made at least 24 hours in advance.
  • Rescheduling and cancellation at least 24 hours in advance are allowed without penalty.
  • Cancellations made less than 24 hours before the scheduled appointment are subject to a $49 cancellation fee.
  • Rescheduling requests made less than 24 hours before the appointment are subject to a $49 rescheduling fee, payable before the new appointment can be confirmed.
  • If weather prevents a shoot, we will reschedule at no additional cost.

3. Payments & Refunds

  • Payment is required at the time of booking through Stripe or other approved methods.
  • Services will not be delivered until payment is received in full.
  • Refunds, when applicable, will be issued to the original payment method within 5–7 business days.
  • Pricing is based on the heated area provided at the time of booking. If the actual heated area exceeds the selected service category, ClearSight Studio may adjust the invoice. Any extra charges must be paid before final media is delivered.

4. Delivery of Media

  • Completed photoshoots will be delivered via email with a download link.
  • Weekday shoots → delivered the next business day.
  • Weekend shoots → delivered the following Monday.
  • Delivery times may be adjusted due to force majeure (technical issues, weather, system downtime). Clients will be notified of any delays.

5. Drone Services & FAA Compliance

  • All aerial services are conducted under FAA Part 107 certification.
  • Flights may be rescheduled or canceled due to weather, safety, or FAA airspace restrictions.
  • If the property is in a restricted “No Fly Zone”:
    • The Client may substitute ground photography/video of equal value, or
    • Receive a refund for the drone portion only.
  • The remainder of the booking (photos, video, 3D tours, floor plans) will still be completed.

6. Media Ownership & Copyright

  • ClearSight Studio grants clients a limited license to use delivered media solely for marketing the listed property while it is active for sale or rent.
  • Resale, transfer, or sublicensing requires written consent.
  • All media remains the intellectual property of ClearSight Studio, which retains the right to reuse, adapt, or resell content.

7. Liability

  • We are not responsible for delays caused by weather, property access, or FAA restrictions.
  • We are not responsible for staging, cleaning, or preparation of the property.
  • Our liability is limited to the total amount paid for the service.

8. Termination of Engagement

We are committed to professional relationships. If continuing services is not in the best interest of either party, we may terminate the engagement with written notice (including email).

9. Governing Law

These Terms are governed by the laws of the State of Florida, including the Florida Information Protection Act (FIPA), and applicable U.S. federal laws.
